Important Updates to Maltese Employment Law

The last three months of 2022 saw some important developments in the sphere of Employment Law. The implementation of the Work-Life Balance for Parents and Carers Regulations, S.L. 452.125, the Transparent and Predictable Working Conditions Regulations, S.L. 452. 126 as well changes to the provisions of the EIRA concerning probation and fixed term contracts has necessitated a review of existing contracts of employment and of employment manuals to ensure compliance with these changes.

With 2023 set to bring about more changes in the sphere of employment, existing contracts need to be reviewed to ensure that they respect the principles enshrined in these new provisions, however, this is also a good time to introduce an employment manual or update it if you already have one in place. The manual is a useful tool that allows you to regulate certain aspects of the employment relationship in a flexible manner by incorporating company policies on a wide variety of matters including dress code, leave, sick leave, flexible work arrangements (remote working/flex-time), training, use of IT and social media and disciplinary matters. The employer can update the manual from time to time to reflect the exigencies of the company / legal developments.
